Who we are: DAH Holdings Pty Ltd - Part of the Auto Europe LLC Group - ABN 67 107 041 912 (“DriveAway”) is a member of The Australian Federation of Travel Agents Limited (AFTA) and the Council of Australian Tour Operators (CATO).
Application: These terms and conditions apply to any contract made between DriveAway and any person (referred to as the “Customer”) purchasing goods or services referred to on this website from DriveAway.
How to Book: Contact your licensed Travel Agent, visit www.driveaway.co.nz or call DriveAway.
Quotes: Car Rental and Motorhome quotes are valid for 3 days and are in New Zealand Dollars.
Deposit: Supplier levied deposits may be required and will be advised at time of reservation. Please note: Some supplier deposits may be non-refundable and will be advised at the time of reservation.
Payment: Where bookings are made by credit card, a 2% surcharge will be charged on the total amount.
Invoices: An invoice is sent upon confirmation of your reservation outlining all aspects of products booked. Confirmations are subject to unadvised changes in depot hours, fleet conditions, stopsells and one way hires until full payment has been received.
Travel Documents: Once payment is received, a travel voucher will be issued. For special requests i.e. child seat, ski rack etc and /or specialty vehicles, a travel voucher is issued upon full payment and once confirmation has been received from the supplier. Please note vouchers are accountable documents and serve as exchange vouchers for products you have booked. Non-presentation of your vouchers may result in charges being applied locally. There are some instances however where documentation is not required. This will be advised at time of reservation.
Amendments: No charge, unless applied by the supplier. If an amendment occurs, DriveAway reserves the right to re-price. All amendments must be made directly with DriveAway. Conditions apply. In some cases, travel agent charges will also apply. Further details can be found here.
Reissue Fee: No charge, unless applied by the supplier.
Frequent Flyer Points: Not applicable on any DriveAway car rental rates, motorhome rates and/or land products.
Refunds: No refund will be made on any part of a package provided and not used; this includes unused car & motorhome rental days. DriveAway does not authorise the employees of any supplier to promise refunds to clients.
Travel Insurance: We strongly recommend that you take out suitable travel insurance with maximum rental vehicle excess cover. Alternatively, ask DriveAway for a DriveAway Excess Refund Protection rate to cover the rental vehicle excess amount.

Rates do not include: Fuel; Oil; Tolls; Optional accessories; Airport/City/Railway/Ferry/Premium Location Fees where applicable; Insurance excess; Refundable security deposit; Vehicle License fees where applicable; Personal Accident Insurance; Additional drivers; Young/Senior driver surcharges; One way fees where applicable; Local Tax, Airport Fees and/or Administration Recovery Fees on additional charges paid locally; Flat or damaged tyres; Fines or penalties due to traffic violations; Loss or theft of vehicle keys and transponder card; Theft of personal belongings inside the vehicle. Pre-booked additional/optional items and associated local taxes are paid directly to the car supplier at the time of collecting the rental vehicle and are not included in the daily rental rate.
Vehicle Type: All vehicles are reserved by group. Models shown are examples only and a similar vehicle may be supplied. Specific models and/or literage cannot be guaranteed.
Winter Tyres - For rentals November to March winter tyres may be compulsory for travel to some European countries. We recommend that winter tyres are fitted between November and March when driving to the German, Swiss and Northern Italian Alps. Not available with all vehicle types or all suppliers. Refer to the Terms & Conditions on your voucher or contact DriveAway for further details.
Security Deposit: All car rental companies require a minimum of one internationally recognised credit card (Prestige/Luxury cars require two credit cards) for a security bond. Cash security deposits are possible in some instances but must be requested in advance. Strict conditions apply. Contact DriveAway for details.
Age Limit: Generally the minimum age is 21 years (30 years for some luxury vehicles) but can vary between car rental company and country. Maximum age limits apply in some countries. A young/senior driver surcharge may apply. Please check at time of booking.
Drivers Qualifications: All drivers must hold a full valid drivers licence with a clean driving record for a minimum of one year. Some countries require a licence to be held for a longer period. A learner or provisional drivers licence is not accepted. An international licence is required for many countries including Austria, Belgium, Czech Republic, Germany, Greece, Italy, Poland and Spain. Fuel: Rates do not include fuel. Rental cars are supplied with a full tank of petrol on collection (exceptions apply). You are advised to refuel your car prior to return and maintain receipts to avoid refueling charges. Some companies may offer a pre-paid fuel option, which is a predetermined amount regardless of the amount of fuel remaining upon return of your vehicle. If accepted no refund is available.
Insurance Excess: In the event of theft or accidental damage to the vehicle, an excess will apply. Adequate travel insurance is strongly recommended.
Excess Reduction: In some countries it is possible to purchase additional insurance to reduce the excess amount payable. If the additional cover is accepted, charges are non-refundable. Alternatively, ask DriveAway for a prepaid DriveAway Excess Refund Protection rate to cover the car excess.
Optional Accessories: Child seats, ski racks, snow chains, winter tyres, GPS etc should be requested at time of booking and subject to availability upon arrival. Additional fees apply and are paid locally.
One Way Rentals: If you return your vehicle to a different location than its origin (be it international or domestic), you may incur a one way fee. Charges and conditions vary between suppliers and car types. Details will be advised at time of reservation. If you vary your drop off point, additional charges may apply.
Geographic Restrictions: It is important to advise your Travel Agent and/or DriveAway at time of booking if you intend to drive your rental car outside the country of rental as conditions and charges may apply. DriveAway takes no responsibility for problems occurring as a result of non-advice.
Information: Any information previously provided to you on DriveAway Hire Car Excess Refund Protection is only a summary of the benefits, please read the following carefully and seek clarification if you do not understand any points. Please note: DriveAway Hire Car Excess Refund Protection is available to New Zealand Residents only.
Age Limit: There is no cover for anyone who has reached the age of eighty-five (85) years or older.
What is Covered: DriveAway Hire Car Excess Refund Protection will cover you for damage and theft excess costs incurred up to NZD5,000. DriveAway Hire Car Excess Refund Protection will cover damage to windows, windscreen, wheels, tyres, the roof, underside of the vehicle. Includes also towing costs, key replacement, mis-fuelling, and administration fee.
Off Road: DriveAway Hire Car Excess Refund Protection does not cover claims where the vehicle (including 4 wheel drives) is taken off road or on unsealed surfaces.
Driver Negligence: DriveAway Hire Car Excess Refund Protection does not cover driver negligence whereby the driver is under the influence of alcohol or other substances. In addition, the driver of the vehicle must meet the requirements of the car rental supplier.
Theft: Theft covers the vehicle only, not personal contents.
Lost/Damaged Keys: In the event that keys are lost and/or damaged, DriveAway Excess Refund Protection will cover you for a maximum of NZD500.
Local Excess Reduction: Supplier excess reduction options may be available directly from a supplier at an additional cost. If the renter accepts any excess reduction offered by the supplier they are not entitled to a refund from DriveAway.
Unused Days: DriveAway Hire Car Excess Refund Protection is pre-paid and is non-refundable for unused days.

Liability: Certain provisions of the Competition and Consumer Act (including, without limitation, the Australian Consumer Law) and other State, Territory or Commonwealth laws in Australia, as amended or replaced from time to time, (collectively “ACL”) apply to the operation of these terms and conditions and provide consumers (as that expression is used in the ACL) and others with certain rights (referred to collectively as the “consumer guarantees”) in relation to goods or services purchased by those persons. Other than consumer guarantees, which are not excluded, modified or restricted by this provision, DriveAway does not give any guarantee or warranty or make any representation of any kind, express or implied, with respect to the supply by DriveAway or others of any goods or services on this website.
Other than in respect of goods or services supplied to consumers or goods or services that are of a kind ordinarily acquired for personal, domestic or household use or consumption, DriveAway’ liability for the breach of any condition or warranty, whether express or implied (other than warranties or conditions in relation to title, encumbrances and quiet possession) is limited, at DriveAway’ option, to:
Subject to rights that the Customer may have under the ACL, which are not excluded, modified or restricted by this provision, DriveAway is not liable to the Customer or any other person, whether in contract, tort or otherwise, for any loss or damages (including without limitation specific, indirect, consequential or economic loss) howsoever caused arising from any event.
Notwithstanding anything contained on this website, nothing in these terms and conditions:
Responsibility for Information: Vehicle specifications, photographs, illustrations, third party charges, third party conditions and information relating to goods or services provided by third parties contained on this website (collectively “Information”) are provided by third parties to DriveAway. All Information is subject to change without notice. The Customer must not rely on this Information. Any descriptions of the goods or services of any third parties in the Information is by way of identification only and the use or reliance on that description by any person shall not constitute any contract between that person and DriveAway as a sale by description. The Customer must make their own independent enquiries and investigations and undertake their own assessment of any Information before deciding whether or not the goods or services referred to in the Information are suitable for the requirements of the Customer.
Supply of Goods or Services by Third Parties: The goods and services identified on this website may be provided by a third party. In order for the Customer to obtain goods and services provided by a third party, the Customer may be required by that third party to agree to, and be bound by, terms and conditions that are specified by that third party. Any person intending to enter into an agreement with a third party must make their own independent enquiries and assessments in relation to the effect of the terms and conditions of that agreement before doing so. Subject to rights that the Customer may have under the ACL, which are not excluded, modified or restricted by this provision, the Customer acknowledges and agrees that DriveAway has no control over and no responsibility for any terms and conditions agreed between the Customer and a third party.
These terms and conditions are governed in all respects by the law of the State of New South Wales and the Customer irrevocably submits to the non-exclusive jurisdiction of the Courts of New South Wales and the Federal Court of Australia.
